Customer Terms
1. About these terms
These terms apply when you request a quote from us, place an order, or use a service or product supplied by Mirai Technologies Pty Ltd (ABN 73 703 187 008). That includes services offered on mirai.com.au and on our business websites: Mirai Technology, Mirai Computers, Mirai Internet, Mirai Mobile, Mirai Voice, Mirai Systems, Mirai Designer, Mirai Printing and Mirai Visual.
Some services have their own terms, for example the Mirai Chat Terms of Service, a service schedule or a signed agreement. If those terms differ from these, the more specific terms apply to that service. Our Privacy Policy and Cancellations, Refunds and Delivery page form part of these terms.
2. Quotes and orders
- A quote is valid for 30 days unless it says otherwise. Hardware prices and availability depend on supplier stock, and we confirm them again before we accept an order.
- An order is accepted when we confirm it in writing or start the work. We may decline an order, for example if stock is not available or a service cannot be supplied at your address. If you have already paid, we refund you in full.
- Prices are in Australian dollars. Prices shown on our websites include GST unless they are marked “ex GST”. Business quotes may show prices excluding GST, with GST added on the invoice.
3. Our services
We provide our services with due care and skill and as described in your quote, order or service schedule. Internet, phone and mobile services rely on wholesale carriers and networks that we do not control. Speeds, coverage and availability can vary. Any service level and service credits apply only where your order includes them.
4. Hardware and other goods
- Ownership of goods passes to you when we receive payment in full. Risk passes to you when the goods are delivered or collected.
- Manufacturer warranties are in addition to your rights under the Australian Consumer Law. We will help you make a warranty claim.
- Delivery, collection and returns are explained on our Cancellations, Refunds and Delivery page.
5. Invoices and payment
- Monthly services are invoiced monthly in advance. Projects and hardware are invoiced as set out in the quote, which may include a deposit.
- Payment terms are shown on each invoice. Unless the invoice says otherwise, payment is due within 14 days of the invoice date.
- Card payments are made through a secure payment page provided by our payment provider, Revolut. We accept Visa and Mastercard, plus Apple Pay, Google Pay and Revolut Pay. We never see or store your full card number. We do not add a card surcharge.
- Bank transfer and PayID payments go to the account shown on your invoice. Please use the invoice number as the payment reference.
- Our bank details will not change by email. If you receive a message asking you to pay a different account, do not pay. Call us on 08 6300 4000 to check first.
6. Automatic card payments (optional)
You can ask us to charge a saved card automatically for your regular invoices. We only do this with your written authority. When you give it:
- We charge the amount of each invoice covered by your authority on or after its issue date. Invoices are issued and their amounts are set out before the charge is made.
- We will tell you at least 7 days before we start charging a different amount for a service, unless the change comes from a change you asked for.
- Your card details are held by Revolut, not by us. You can update the card or cancel the authority at any time by contacting us. A cancellation reaches the next charge if we receive it at least 1 business day before that charge.
- If a charge fails, we will tell you and may try again. We will not try more than 3 times for the same invoice.
7. Late payment
If an invoice is overdue, we will send you a reminder. If it stays unpaid, we may suspend the affected service after giving you written notice and a reasonable chance to pay. A person at Mirai makes that decision; it is never automatic. We restore the service promptly once the account is paid.
8. Questions about a charge
If you think a charge is wrong, please contact us first. We will look into it and respond within 2 business days. If we have charged you in error, we refund the amount in full. Contacting us first is usually faster than disputing the charge with your bank.
9. Cancellations and refunds
How to cancel a service, our refund rules and how refunds are paid are explained on our Cancellations, Refunds and Delivery page.
10. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded (your “non-excludable rights”).
11. Liability
- Subject to section 10, if you acquire goods or services as a business and they are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the goods or services again, repairing or replacing the goods, or paying the cost of doing so.
- Subject to section 10, our total liability to you in connection with a service is limited to the fees paid and payable for that service in the 12 months before the event giving rise to the claim.
- Neither party is liable for indirect or consequential loss, except where a non-excludable right applies.
- These limits do not apply to liability for death or personal injury caused by negligence, fraud or wilful misconduct, your obligation to pay for goods and services you have received, or any non-excludable right.
12. Changes to these terms
We may update these terms. We publish each version on this page with its version number and effective date. If a change is to your detriment and affects a service you already have, we will tell you at least 30 days before it takes effect. You may then cancel that service without an early termination fee before the change takes effect.
13. Governing law
These terms are governed by the law of Western Australia. Nothing in this section limits your rights as a consumer.
